1. Platform Purpose
Caprice (the "Platform") is an adult digital content platform that allows:
- Creators to publish and monetize adult digital content (photos, videos) intended for a consenting adult audience
- Members to access this content, interact with creators through messaging, and order custom content
WARNING — ADULT CONTENT: The Platform contains content explicitly reserved for adults. Access is strictly prohibited to persons under 18 years of age (or the legal age of majority in your jurisdiction).
Caprice acts as a technical intermediary. The Platform provides the infrastructure enabling the publication, secure storage and distribution of adult digital content. Caprice is not the producer of content published by Creators.
2. Acceptance of Terms and Age Verification
By creating an account or using the Platform, you represent that you:
- Are at least 18 years old (or the age of majority in your jurisdiction)
- Fully accept these Terms of Use
- Are voluntarily accessing explicit adult sexual content
- Are not a vulnerable person or acting under duress
- Will use the Platform in compliance with the laws applicable in your country
Declaring you are of legal age at registration is a legal commitment. Anyone accessing the Platform by lying about their age exposes themselves to legal prosecution. Caprice reserves the right to require identity verification at any time.
3. Account Types
3.1. Creator Account
Reserved for adult content creators who wish to monetize their production:
- Free registration with identity verification (required to receive payments)
- Publication of adult digital content (photos, videos) via the portfolio and studio
- Independent setting of prices, services offered and availability
- Management of custom content orders
- Communication with members through integrated messaging
- Receipt of net payments after the Platform's commission (15%)
- Access to portfolio management and statistics tools
Status of Creators: Creators operate as independent self-employed workers. They are neither employees, agents, nor representatives of Caprice. They are solely responsible for their content, their tax obligations, and compliance with applicable laws.

3.2. Standard Member Account
Standard, limited access to the Platform:

- View public portfolios

Free account limitations:
- Maximum 5 orders per month

3.5. Subscription Policy
- Subscriptions renew automatically at each billing period
- Cancellation is possible at any time from your dashboard
- In case of cancellation, access remains active until the end of the paid period
- No partial refund for periods already started
- Upgrading to a higher plan is possible at any time
4. Content Published by Creators
4.1. Nature of Permitted Content
- Adult photos and videos, between consenting adults
- Custom digital content made to order
- Artistic, suggestive or explicitly sexual content involving only adults of legal age
4.2. Strictly Prohibited Content
- Any content involving minors, including fictional or simulated depictions of minors in sexual situations
- Non-consensual content (voyeurism, revenge porn, recordings made without consent)
- Content involving animals (bestiality)
- Non-simulated violence or illegal acts
- Identity theft or publication of content belonging to third parties without authorization
- Content promoting human trafficking, exploitation, or smuggling
Any illegal content will be immediately removed and reported to the competent authorities, including the National Center for Missing & Exploited Children (NCMEC) where applicable.
4.3. Verification and Moderation
Caprice reserves the right to moderate, suspend or remove any content without notice in the event of a violation of these Terms. Creators may be required to provide proof of identity and age for any subject appearing in their content.
Identity verification process (KYC): Caprice may require Creators to submit an official identity document through the platform. The document is reviewed by the moderation team, and a "Verified" status is displayed on the Creator's public profile once validated. Submitted documents are never publicly displayed and are stored securely in accordance with the Privacy Policy.
5. Custom Content Orders
The Platform allows Members to order custom digital content (photos or videos) from Creators.
Service characteristics:
- Orders are for digital content only (delivered through the Platform)
- No physical interaction or in-person meeting is arranged through Caprice
- Strict confidentiality of exchanges and orders
- Caprice holds funds in escrow until delivery is confirmed
Any request for a physical meeting, in-person service, or solicitation of services outside the Platform is strictly prohibited and results in immediate account suspension.
6. Artistic Sessions Between Premium Plus Members and Creators
The Artistic Session feature (payment label: Artistic Session Order) allows Premium Plus members to propose and organize in-person creative sessions with Creators — for the sole purpose of producing adult digital content (photos, videos) in a professional, consensual setting.
What an Artistic Session allows:
- Proposing a photo or video shoot project to a Creator
- Defining the location, date, duration and terms of the session through the Platform's messaging
- Finalizing an agreement on compensation and delivery of the produced content
- Access to a project tracking and management space (Premium Plus Account required)
MANDATORY CLAUSE — MUST BE READ:
- Artistic Sessions on Caprice do not, under any circumstances, constitute an offer, request, or facilitation of paid sexual services, prostitution, or any equivalent act.
- Any request of a paid sexual nature, any solicitation involving financial compensation for sexual acts, or any arrangement outside the scope of digital content production is strictly prohibited and results in immediate and permanent suspension of the account, as well as a report to the competent authorities.
- Caprice tolerates no ambiguity on this point. In case of doubt, the protection of individuals takes precedence over any other consideration.
Conditions for a valid Artistic Session:
- Reserved exclusively for holders of an active Premium Plus Account
- The Creator must freely accept the proposal — no pressure or obligation on her part
- Both parties must be adults and give their explicit consent
- The agreement must be formalized through the Platform before any in-person session
- Caprice acts as an intermediary facilitating the connection — responsibility for the proper conduct of the session rests with both parties
7. Payments and Commissions
7.1. Payment Methods
The Platform accepts payments by credit card (Visa, Mastercard) and by cryptocurrencies for all transaction types: subscriptions, custom content orders, artistic session orders, and tips.
7.2. Fee Structure
Member Subscriptions:
- Standard: $0 — limited features (5 orders/month, 2 active)
- Premium: $4.99/month or $49.90/year (2 months free)
- Premium Plus: $9.99/month or $99.90/year (2 months free)
Commission on content orders:
Caprice commission model:
- Total commission: 15%, split into 10% on the Creator's side (deducted from her earnings) and 5% on the Member's side (added to the displayed price)
- Commission capped at $30 maximum for any order (threshold reached at $200)
- Beyond $200, the commission remains fixed at $30 — the Creator keeps the entire surplus
- Payment processing fees are absorbed by the Platform — invisible to both the Member and the Creator
- Applicable local taxes are calculated and displayed before payment confirmation

7.3. Creator Payouts
- Frequency: twice a month (around the 1st and 15th)
- Minimum threshold: $50 — any balance below this is carried over to the next cycle
- Processing time: 3 to 5 business days after the payout date
- Currency: USD ($) only
- Methods: international bank transfer (IBAN) or cryptocurrencies
- A payout may be suspended in the event of suspected fraud, an unvalidated bank document, a violation of the Terms, or an ongoing chargeback

7.4. Payment Policy
- Payments for orders are made before the content is created
- Funds are held in escrow by Caprice until delivery is confirmed
- The Creator is paid after validation by the Member
- In the event of a dispute not resolved within 7 days, Caprice arbitrates and makes a final decision
- Tips are processed immediately — the Creator receives 90% of the amount, Caprice 10%
- The price displayed by the Creator is her net price; taxes and fees are calculated and displayed in real time before payment
7.5. Refund Policy
- Subscriptions: No refund for periods already started
- Content orders: Full refund if the Creator cancels or fails to deliver within the agreed timeframe
- Artistic session orders: Full refund if the Creator cancels or does not show up
- Tips: Non-refundable once confirmed
- 14-day right of withdrawal for residents of the European Union (before any digital content is delivered)

8. Prohibited Behavior
- Harassment, threats, blackmail toward Creators or other Members
- Requests involving minors or suggesting the involvement of minors
- Bypassing the payment system (direct transactions outside the Platform)
- Soliciting physical meetings through the Platform's messaging
- Fake profiles or identity theft
- Capturing, distributing or redistributing Creators' content without authorization
- Spam, unauthorized automation or any attempted technical attack
- Sharing other users' personal data without consent
9. Intellectual Property Rights
Creators retain full rights to the content they publish.
- By publishing on the Platform, the Creator grants Caprice a limited, non-exclusive and revocable license to store, display and distribute this content through the Platform
- Members purchase a non-transferable personal viewing right — any reproduction, download, distribution or redistribution is strictly prohibited
- Caprice acquires no ownership rights over the published content
- Any copyright infringement may result in account suspension and legal action

11. Privacy and Data Security
- Personal data is processed in accordance with applicable data protection laws
- Passwords are hashed — never stored in plain text
- Payments are secured through cryptographic signature mechanisms
- Media is stored in encrypted form and distributed via a secure network
- No banking data is retained on our servers
- IP addresses and access logs are retained for security and legal compliance purposes

12. Termination and Suspension
12.1. Suspension or Removal by Caprice
Caprice reserves the right to suspend or delete any account in the event of:
- Violation of these Terms
- Publication of illegal content (in particular content involving minors)
- Fraudulent activity, harassment or abusive behavior
- A request from judicial authorities
- Behavior harmful to the integrity or reputation of the Platform
In the event of suspension:
- Immediate loss of access to the Platform and paid features
- No refund of ongoing subscription periods
- Reporting to the competent authorities if the content is illegal
12.2. Cancellation by the User
Paid subscriptions:
- Cancellation possible at any time from the account
- Cancellation takes effect at the end of the current paid period
- No refund for the current period
- The account automatically switches to Standard Member upon expiration
12.3. Permanent Account Deletion
To request the complete deletion of your account and your data, contact support@caprice.adult.
- Personal data will be deleted in accordance with applicable data protection laws
- Financial data and transactions will be retained for the legally required periods (tax obligations)
- Published content will be removed from our storage servers
13. Limitation of Liability
To the extent permitted by law, Caprice disclaims all liability for:
- Service interruptions (scheduled maintenance or technical outages)
- Financial losses related to cryptocurrency fluctuations
- The quality or compliance of content published by Creators
- Disputes between Creators and Members
- Indirect, consequential or punitive damages
Caprice's maximum liability cannot exceed the amount of commissions or subscriptions collected over the past 30 days for the account concerned.
14. Governing Law and Jurisdiction
These Terms are governed by the laws applicable at the Platform's place of establishment.
In the event of a dispute, the parties will first seek an amicable resolution. Failing that, the courts having jurisdiction based on the Platform's place of establishment will be seized.
Each user is also subject to the local laws of their country of residence, in particular regarding the protection of personal data and access to adult content.
15. Changes to the Terms
Caprice may modify these Terms at any time. Users will be notified by email or via a banner on the Platform at least 7 days before the changes take effect.
Continued use of the Platform after the effective date constitutes acceptance of the new Terms.
