1. Platform Purpose

Caprice (the "Platform") is a professional digital marketplace connecting:

• Content creators (photographers, videographers, models, digital artists) — "Creators"
• Businesses, producers, studios and professionals looking for creative collaborations — "Producers"

2. Acceptance of Terms

By creating an account or using the Platform, you represent that you:

• Are at least 18 years old (or legal age in your jurisdiction)
• Accept these Terms of Use in full
• Use the Platform in compliance with applicable law
• Act in a professional, lawful and declared framework

3. Account Types

3.1. Creator Account

• Free registration (identity verification may be required)
• Professional portfolio management
• Independent pricing and availability settings
• Collaboration management tools
• Unlimited messaging via the platform
• Net payout after platform commission (20%)

3.2. Free Member Account

• 100% free registration
• Browse creators and public portfolios
• Request custom content
• Read-only chat access

3.3. Paid Member (USER) — $12.99/month

• Unlimited messaging
• Unlimited orders, no monthly restriction
• Unlimited simultaneous active orders
• Priority content order processing
• Advanced search filters
• Member badge and full core features

3.4. PRODUCER Plan — $24.99/month

• Everything in USER plan
• Creative project management features
• Contract templates
• Advanced analytics
• Priority support

3.5. Subscription Policy

• Subscriptions renew automatically
• Cancellation is available from your dashboard
• Access remains active until the paid period ends
• No pro-rata refund for periods already started

4. Caprice Role and Responsibilities

Caprice provides:

• A secure technical infrastructure
• Payment flow and commission management
• Professional communication tools
• Escrow-style safeguards until agreed milestones

5. Payments and Commissions

5.1. Payment Methods

Payments are processed by credit/debit card (Visa, Mastercard) and cryptocurrencies for all transaction types: subscriptions, custom content orders, and tips.

5.2. Fee Structure

Caprice charges a total commission of 20% per transaction, capped at $30 maximum (cap reached at $150). Split: 15% deducted from the Creator's earnings + 5% added to the Member's displayed price.

5.5. Order Payment Policy

Work starts only once payment is confirmed. Funds may be held until delivery conditions are met.

5.6. Custom Content Orders

Custom orders must contain clear specifications, budget and expected scope.

5.7. Subscription Refund Policy

Subscription fees are generally non-refundable once the billing period has started, unless required by law.

6. Permitted and Prohibited Uses

6.1. Permitted Uses

• Professional collaboration and creative production
• Lawful messaging and file exchange within platform rules

7. Intellectual Property

Each party retains ownership of its pre-existing IP. Usage rights for commissioned content must be agreed contractually between parties. Users warrant they have all rights and permissions required for uploaded content.

10. Termination and Suspension

10.1. Suspension by Caprice

Caprice may suspend or terminate accounts for policy violations, security risks, fraud suspicion, legal compliance requirements, or harmful behavior.

10.2. User Cancellation

Users may close paid plans from the subscription dashboard: subscription management.

10.3. Account Deletion

Deletion requests can be sent to support@caprice.adult. Some financial records may be retained for legal/tax obligations.

11. Limitation of Liability

To the maximum extent permitted by law, Caprice is not liable for indirect or consequential damages, business loss, service interruptions, third-party misconduct, or disputes between users.

12. Governing Law and Jurisdiction

These Terms are governed by the laws of Québec and Canada. Any dispute falls under the competent courts of Montréal, Québec.

13. Changes to Terms

Caprice may update these Terms at any time. Continued use after notice constitutes acceptance of the updated Terms.
